Tappedout has him listed as banned for Modern, but when I checked the ban list here: http://www.wizards.com/magic/tcg/resources.aspx?x=judge/resources/sfrmodern

he isn't banned. Is he, or is he not?

I would trust the wotc site more so than tappedout, not that im dissing the site or anything but i would assume from the wizards site it is un banned. Because it it's straight from the people at wizards anyway thats how i view it.

It isn't banned. Always defer to Gatherer for questions about card legality except in the case of EDH. EDH rules are listed on a third-party website.

I always like to use MagicCards.info -- it's kept up by the guys at MTGSalvation.com. It has up-to-date ban lists. While there isn't a literal list on the site of banned cards, each individual card is listed along side its legal formats. It keeps up with 1.0, 1.5, 2.0, Modern, EDH/Commander (not 100-card singleton) and MTGO Classic.

So you know, the legality system for Tapped Out is based on format-legality flags being manually added to individual cards, and those flags mark the formats the card is legal in rather than those it's banned in. If Kokusho, the Evening Star is missing the Modern-legal flag that means someone forgot to hit him with it after Modern was established as an official format. As others have said, always go by Gatherer for legality. The only mistakes I've noticed there have to do with Commander, and that's because MtGO Commander is slightly different than actual Commander (for that format, use mtgcommander.net).
