No, Commander sets are only legal in Commander, Legacy, and Vintage

No, for it to be modern legal, it needs to have been printed in a standard legal set (expert expansion or core set) that's also modern legal. The example is Scavenging Ooze which was first printed in the original commander set but was not modern legal till it was reprinted in m14. Flusterstorm also from the same commander set hasn't seen a reprint and is not modern legal.

Rules questions should be asked in the Q&A, which is linked in the header bar.

Only eternal formats include all cards ever released. Standard and Modern, which are not eternal formats, only get new cards from core sets or blocks.
