Death by Dragons is not Modern Legal. Cards legal in modern are those printed in sets starting from Mirrodin block. Death by Dragons was only printed in the Commander product which is not a set, thus this card does not qualify.

There may be other cards there, I haven't scanned the entire deck list. This is the first thing that I saw.

Actually, Modern legality begins with 8th Edition. The rules for Modern deck construction can be found here.

Tertiary products like Commander precons do not add cards to the Modern pool, and cards that appear in these products without also appearing in a Modern-legal set are not legal for play in Modern.

Your deck has cards in it before Eighth Edition and from non-Modern-legal sets, specifically Imperial Hellkite , Kilnmouth Dragon , and Mana-Charged Dragon .

Also, if this tournament costs money to enter, I would highly suggest that you save your money by not playing that list. It's quite bad.

So everyone else saw Death by Dragons and that's the one I missed? lol.

Imperial Hellkite and Kilnmouth Dragon are also not legal in Modern.

I really advise against playing this deck in a Modern tournament. It's very inconsistent due to the scattered creature base, and you're likely to die quickly to the tempo decks that dominate the Modern meta.

Play in the modern tournament. Regardless of how good or bad the deck is, I encourage you to go check out the event

I'm on Epoch's side. Tournaments are tournaments. The kind will tell you to make it 60 cards and the rude will mock you behind your back that you brought that deck into a modern tournament. It might be cool to tour an event, but you can't even compete with that thing - you're giving your opponents free wins. Basically, if you don't know the basic rules of modern deck construction, I recommend against entering.

If the tournament is an FNM or a More casual event that the organizer listed as Modern to simply have a deckbuilding restriction (some school mtg clubs will do this) feel free to attend as the entry fee will generally be cheap enough and the more competitive players who maybe there will hopefully be kind enough for the experience to be decent.

If the event is anything more major it'd be best to not join it with that deck. Also this article link would be a great read if you want to learn how to build good mtg decks on any budget! http://www.wizards.com/magic/magazine/article.aspx?x=mtg/daily/rc/188
