Copyright of background images?

I want to put a background image on my profile, and have the code to do so, but it requires a URL and the art I want is from a Magic card. Is it considered fair use to use this artwork? Do I need to acknowledge the artist or copyright owner of the art and/or URL, or is it understood that it is only for fair use purposes?

Just play it safe by acknowledging the artist and let people visiting your profile know that the image is owned by wizards of the coast. Even if that's not necessary you'll be covering your back I think.
Please anyone let me know if I'm wrong.
