If I have a Abyssal Persacuter and my opponent has no cards left in library what happens?. Does the Persy still need to be removed?
While Abyssal Persecutor is on the battlefield in your control, you can't win the game, and your opponents can't lose...
So any conditions that force the opponent to lose means that they don't. Even if your opponent has no deck, they can still be in the game until Abyssal Persecutor leaves.

I had a question about that answer.
I was told that with the Persecutor on the board the opponent's Life never becomes negative. So I could keep hitting for negative but if he gains 1 life he gains it from 0 not from -40
If I go to remove Pesecutor and the opponent fast effects a life gain some how he will not lose the game?

Ya should place this as a seperate question to be honest. It's asking about a different dimension of the issue at hand.
To answer your querry, if the card doesn't say anything about negative life, then the opponent will go down to negative figures when he takes damage.
card:Angel's Grace would be one such card that would be worded to a way to which your opponent would be right, but Abyssal Persecutor doesn't have any such clause, therefore your opponent will continue to take damage.

Yes. You cannot win the game with him on the table. Just like if you have your opponent at -40 life and you're at +10 you have to get him off the table to win.
